The website serves consumers and businesses. Consumer-specific rules are described below. White label and private label projects may be governed by an individual quote and contract accepted before production. Where terms differ, that document sets the project terms without removing any mandatory consumer rights.
1. Products and information before ordering
Essential characteristics, formats, prices and availability are shown on each product page. Lifestyle photographs do not replace the product information. Custom products are defined in the accepted quote, including formula, packaging, quantity, label, price and estimated schedule. A quote request is not an order.
Presentation and packaging of scented products: product photographs illustrate a possible presentation. Depending on the packaging available when the order is prepared, a product may be sent in a bottle or vial with a different shape or colour from the photograph, including black, and the cap may also be black or different. This variation concerns the exterior presentation: the product, scent, quantity, use and stated characteristics of the ordered item remain as ordered. If a particular bottle, cap or label is expressly stated as a characteristic on the product page or agreed in a quote, it cannot be replaced without the customer’s consent. This information does not restrict statutory rights for lack of conformity.
2. Prices, taxes and charges
Prices are shown in euros, inclusive of tax. For delivery in France, the VAT rate stated by COSMY LLC is 20% and VAT is included in the displayed price. The product amount, applicable VAT, shipping costs and total are summarised before the order is confirmed. VAT rules for other delivery countries must still be validated before payments are enabled. An order shipped outside the European Union may incur customs duties and import taxes payable by the recipient and not included in the amount paid on the website.
Shipping is free on products totalling €99 or more after discounts for an address in mainland France, Belgium or Luxembourg. Other shipping charges are displayed before confirmation. No discount for early payment applies unless a quote states otherwise.
3. Ordering and formation of the contract
The customer selects products and quantities, reviews the cart, enters the required details, sees the total cost and can correct errors before confirming an order with an obligation to pay. Confirmation is sent to the email address supplied. If a product becomes unavailable after ordering, COSMY LLC contacts the customer to offer a solution or refund sums received for that product within the applicable legal deadlines.
4. Payment
Only methods actually offered at the final checkout step may be used. Card payment through Stripe, PayPal and bank transfer are planned methods. For bank transfer, instructions are sent to the customer and preparation begins when the funds are received. For a quoted project, payment terms and due dates are those in the quote or signed contract. Instalment payment is available only if the provider expressly offers it at payment.
If a business customer has expressly been granted payment terms, payment is due on the date stated on the invoice. Late payment entails, under applicable law, interest at the European Central Bank refinancing rate plus ten percentage points and fixed compensation of €40 for recovery costs; additional compensation may be claimed on evidence if costs are higher. These provisions do not apply to consumers.
5. Preparation and delivery
For available catalogue items, the preparation target is 48 business hours after payment is confirmed. This is not the transit time. The delivery date or period is communicated before the order is confirmed. Items made to a quote follow the accepted project schedule. The carrier and shipping charge are shown before payment. Collection in person is not offered. Practical details appear on the Delivery and Returns page.
The customer must provide an accurate delivery address and promptly report any delivery problem to [email protected]. For consumers, the risk of loss or damage passes when they, or a third party they designate other than the carrier offered by the seller, physically take possession of the goods. Statutory rights for late or failed delivery continue to apply.
6. Consumer withdrawal
A consumer buying at a distance generally has 14 days from receipt of the goods, or the last item of an order delivered separately, to notify their decision to withdraw without giving a reason. They may use the model form below or send any clear statement to [email protected]. They then have 14 days to return the goods to the address provided by customer service. They pay the direct return costs for a change of mind.
We refund payments received for the relevant goods, including the corresponding standard delivery charges, within 14 days of the withdrawal notice. We may defer the refund until the goods are recovered or proof of dispatch is received, whichever occurs first. Extra costs caused by choosing a delivery method more expensive than the offered standard method are not refunded. The original payment method is used unless another method without charge is expressly agreed.
The withdrawal right does not apply in particular to goods made to the consumer’s specifications or clearly personalised, or to sealed goods that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons, subject to Article L.221-28 of the French Consumer Code. This exclusion does not automatically apply to every cosmetic product: it depends on the product and whether its seal remains intact. Statutory rights remain in every case.
Model withdrawal form — Send to COSMY LLC, [email protected] (postal address: 8206 Louisiana Blvd NE, Ste A #1247, Albuquerque, New Mexico 87113, United States): “I hereby give notice that I withdraw from my contract of sale of the following goods: [description]. Ordered on [date] and received on [date]. Consumer’s name: [name]. Consumer’s address: [address]. Date: [date]. Signature: [only if this form is sent on paper].” Send the return parcel to the French address supplied after the request, not to the US notification address.
7. Commercial 30-day return
Separately from the statutory withdrawal right, COSMY LLC accepts a return request for a standard product that is unopened and in its original condition up to 30 days after receipt. The customer pays the direct return costs. Contact customer service with the order number before sending the product to obtain the French return address. After receipt and inspection, the returned product price is refunded to the original payment method; the initial shipping charge is refunded only where required by law. This commercial option does not apply to custom-made goods and does not remove any statutory right.
8. Statutory guarantees and complaints
Consumers benefit from the statutory guarantee of conformity under Articles L.217-3 and following of the French Consumer Code and the guarantee against hidden defects under Articles 1641 and following of the French Civil Code. The conformity guarantee notably allows a remedy for a lack of conformity appearing within two years of delivery, subject to the legal conditions; a price reduction or cancellation of the sale may also be possible. The hidden-defects guarantee may be exercised within two years of discovering the defect. These rights are separate from withdrawal and the commercial return option.
For a complaint, email [email protected] with the order number, a description of the issue and useful photographs where available. No condition requiring a reservation with the carrier restricts a consumer’s statutory rights.
9. White label and private label
White label is offered from 50 units per item. The customer supplies their label file or may request an introduction to a partner agency; labels, containers and adaptations are priced by quote. An estimated period of two weeks to one month may be indicated and then confirmed in the quote.
Private label is considered from 5 kg of formula, sold by weight. Formulation trials are charged as set out in the accepted quote; the schedule depends on the project’s complexity. The formula definition, any exclusivity, rights of use, regulatory documents, responsibilities for placing the product on the market, and cancellation or amendment terms must be set out in an individual contract signed before the project starts. No transfer of rights or exclusivity follows merely from a quote request.

11. Disputes
If a difficulty arises, first contact customer service at [email protected] to seek an amicable solution. Mandatory consumer protection rules and applicable court jurisdiction in the consumer’s place of residence remain unaffected.
